These Terms + Conditions govern bookings, purchases and participation in services offered by Studio Mōtus, operated by Motus by Thomas Kendall, a sole proprietorship based in Zürich, Switzerland.
They apply to group classes, private and duo training, online private training, workshops and special events, memberships, class and session packages, gift cards, the Virtual Studio and other services offered through studiomotus.ch or our booking platforms.
By booking or purchasing a service, you confirm that you have read and accepted the Terms + Conditions applicable at the time of purchase.
1. Bookings + Accounts
Bookings are subject to availability and must be made through the booking methods provided by Studio Mōtus.
Clients are responsible for providing accurate account information and keeping their login details secure.
Bookings, packages, memberships and session credits are personal and may not be transferred to another person unless expressly agreed by Studio Mōtus.
Studio Mōtus reserves the right to refuse or discontinue participation where reasonably necessary for health or safety, inappropriate conduct, misuse of the booking system or a material breach of these Terms.
2. Prices + Payment
All prices are stated in Swiss francs (CHF) and include VAT where applicable.
Payment is due according to the conditions shown at the time of purchase. Prices, package validity periods, included credits and other conditions displayed at purchase form part of the relevant agreement.
Promotional, introductory and discovery offers are subject to the eligibility conditions stated with the individual offer. Unless otherwise stated, introductory offers may be purchased once per eligible client.
3. Packages, Credits + Validity
Class and session packages are valid for the period stated at the time of purchase.
Unused credits expire at the end of their stated validity period. Purchases are final and unused credits are not refundable, exchangeable or redeemable for cash except where otherwise required by applicable law or expressly agreed by Studio Mōtus.
In the event of injury, illness or pregnancy, Studio Mōtus may consider an extension or temporary suspension upon presentation of an appropriate medical certificate. Extensions and suspensions are assessed individually and are not guaranteed.
4. Monthly Memberships
Studio Mōtus monthly memberships renew automatically each month and have a minimum commitment of two months unless a different term is expressly stated at the time of purchase.
After the minimum commitment has been completed, a membership may be cancelled before the next scheduled billing date. Cancellation takes effect at the end of the current paid billing period.
Charges already processed are non-refundable except where required by applicable law.
The number and type of credits included in each membership are stated at purchase. Membership credits may only be used for the class category for which they were issued unless expressly stated otherwise.
5. Group Classes
Group-class cancellations must be made through the client's Mindbody account at least 12 hours before the scheduled start time.
Late cancellations and no-shows result in forfeiture of the applicable class credit.
For safety and to avoid disrupting the class, clients who arrive after a group class has begun cannot join the session.
If Studio Mōtus cancels a group class, the applicable credit will be returned to the client's account.
6. Waitlist
Clients may join the waitlist for a full group class through Mindbody.
If a place becomes available during the active waitlist period, Mindbody may automatically confirm the next eligible client and apply the relevant class credit.
Clients are responsible for removing themselves from the waitlist if they are no longer available to attend.
Once a waitlist booking has been confirmed, the standard group-class cancellation policy applies.
7. Private, Duo + Online Training
Private, Duo and Online Private Training require at least 24 hours' notice for cancellation.
Late cancellations and no-shows result in forfeiture of the booked session.
A client arriving more than 20 minutes late for a private session may be considered a no-show.
For Duo Private Training, both participants are responsible for purchasing and reserving their sessions separately. If one participant cancels within the late-cancellation period or does not attend, the reserved session is forfeited in accordance with the Duo booking policy.
If Studio Mōtus cancels a private session, the applicable credit will be returned to the client's account.
8. Workshops + Special Events
Workshops and special events require at least 24 hours' notice for cancellation.
Late cancellations and no-shows result in forfeiture of the applicable credit or payment.
Event-specific cancellation or transfer conditions displayed at the time of purchase take precedence over this section.
9. Health + Participation
Physical exercise involves inherent risks.
Clients are responsible for informing the instructor of any injury, illness, surgery, pregnancy, medical condition or other circumstance that may reasonably affect safe participation.
Studio Mōtus instructors provide movement and exercise instruction and do not provide medical diagnosis or treatment. Clients should obtain appropriate medical advice before beginning or returning to exercise where necessary.
Clients are responsible for working within their own abilities, following instructor guidance and immediately stopping an exercise if they experience unexpected pain, dizziness or other concerning symptoms.
Studio Mōtus may modify exercises, recommend a different class or refuse or discontinue participation where there are reasonable safety concerns.
10. Liability
Nothing in these Terms excludes or restricts liability where doing so would be prohibited by mandatory Swiss law, including liability arising from intentional misconduct or gross negligence.
To the extent permitted by law, Studio Mōtus is not responsible for damage resulting from risks inherent in physical exercise where the Studio has fulfilled its applicable duties of care.
Clients remain responsible for their personal belongings. Studio Mōtus is not responsible for loss, theft or damage to personal property except where liability cannot lawfully be excluded.
11. Virtual Studio + Digital Services
A Virtual Studio subscription provides the subscriber with a limited, personal, non-exclusive and non-transferable right to access the digital content made available during the subscription period.
Login details may not be shared. Virtual Studio content may not be copied, downloaded, recorded, reproduced, distributed, resold or made publicly available without permission.
Monthly and annual Virtual Studio subscriptions renew automatically from the original purchase date unless cancelled before the next renewal. Cancellation prevents the following renewal, and access continues until the end of the period already paid for.
Payments already processed are non-refundable except where required by applicable law.
Clients are responsible for having a suitable device, internet connection and safe environment in which to participate in online movement sessions.
Temporary interruptions resulting from technical circumstances outside Studio Mōtus' reasonable control do not automatically give rise to a refund.
The health and participation provisions in these Terms also apply to online and on-demand training.
12. Gift Cards
Gift cards may be used toward eligible Studio Mōtus services in accordance with the conditions stated at purchase.
Gift cards are not redeemable for cash.
Any stated validity period and other redemption conditions are communicated at the time of purchase.
13. Schedule + Service Changes
Studio Mōtus may reasonably change instructors, class schedules or the format of a service where necessary.
A change of instructor alone does not constitute cancellation of a class or session.
Where Studio Mōtus cancels a booked class or session, the corresponding credit will be returned to the client's account.
If circumstances outside the reasonable control of Studio Mōtus materially prevent services from being provided, including government restrictions, building closures, power outages or comparable events, Studio Mōtus may postpone services or extend affected validity periods where appropriate.
Mandatory statutory rights remain unaffected.
14. Intellectual Property + Recording
The Studio Mōtus name, website content, photographs, videos, written material, class materials and other original content are protected by applicable intellectual-property rights.
Clients may not record classes, private sessions or other participants without prior permission.
Nothing in these Terms gives Studio Mōtus permission to use a client's image or likeness for marketing purposes. Any such permission will be handled separately where appropriate.
15. Privacy + Personal Data
Studio Mōtus processes personal data in accordance with applicable Swiss data-protection law and our Privacy Policy.
Information concerning injuries, pregnancy, medical conditions and medical certificates may constitute sensitive personal data and will be handled accordingly.
Please refer to our Privacy Policy for further information about how personal data is collected, used and protected.
16. Changes to These Terms
The Terms applicable to a purchase are those in effect when the relevant purchase or agreement is made.
Studio Mōtus may update these Terms for future bookings and purchases. Material changes affecting an ongoing membership or subscription will be communicated where appropriate and will not override mandatory statutory rights.
If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions remain unaffected.
17. Governing Law + Jurisdiction
These Terms are governed by Swiss law.
Subject to mandatory statutory rules concerning jurisdiction, the courts of Zürich, Switzerland, have jurisdiction over disputes arising from these Terms or the services provided by Studio Mōtus.
Mandatory consumer rights remain reserved.
